Thank you for visiting the Kapsul website located at the kapsulair.com and kapsulair.myshopify.com domains (together with any successor site, the “Site”), or using the related Kapsul mobile application (the “App”). With the exception of portions of the Site owned by Shopify Inc., a third party unaffiliate with Kapsul that provides us with the e-commerce platform for our online store, this Site is owned and operated by Premium Home Comfort Inc. d/b/a Kapsul (“Kapsul,” “we,” or “us”), and we can be reached by mail at Kapsul, 2212 Walnut Street, 1st Floor, Philadelphia, PA 19103 or by email at privacy@kapsulair.com.
We value individual privacy and want to give visitors of the Site and users of our App the opportunity to know what information we collect about them and how they can limit the use of personally-identifiable information beyond the purposes for which they first provided it. At all times, however, Kapsul reserves the right to disclose information where required by law or to comply with valid legal process (such as a search warrant, subpoena, or court order), to protect Kapsul’s rights or property, including without limitation in the event of a transfer of control of Kapsul or substantially all of its assets, or during emergencies when safety is at risk.
This privacy policy (the “Policy”) does not apply to the practices of third parties, such as advertisers, content providers, or other companies and persons that we do not own or control, or to person that we do not employ or manage, including without limitation Shopify Inc. We reserve the right to change the terms of this Policy at any time. However, we will not materially reduce your rights under this Policy without providing reasonable notice to you, such as by posting a notice on our Site or App. Since these policy change notices last only for a limited time, however, you should check this Policy regularly to see if there have been any changes and review the “Last Updated” date at the top of this Policy, which will be revised whenever we make changes. Data We Collect and How We Use It
Personally Identifiable Information
We collect your email address if you subscribe to our mailing list, preorder or purchase products through our online store, create an account to use our App, reach out to us through our “Contact” page, or otherwise communicate with us by email, as well as other information that you might supply voluntarily, such as survey responses, feedback, and reviews.
If you preorder or purchase a product or service at our Site, we will also ask for your name, address, credit card number or other financial account number you wish to be charged, and other contact information. We do not give out your credit card or other financial account information to third parties other than our payment processing and fulfillment vendors unless you authorize us to do so or if it is necessary to fulfill our responsibilities, including without limitation delivering a product or service you order.
We may use this information to respond to an email or other inquiry or request, to help improve our Site, products, or services, to customize your experience at the Site, or to send updates or notices about our company and the products and services we offer that we think may be of interest to you. Kapsul may also collect information from visitors to the Site and users of the App (including names, email addresses, addresses, and phone numbers) for inclusion in a customer or subscriber directory that is utilized by Kapsul to contact such visitors or to market our products and services.
Children's Privacy
The Site and the App are each intended only for adults who are at least 18 years of age or older. Kapsul does not knowingly collect personal information from children under the age of 13. If we obtain knowledge that we have personally identifiable information about a child under 13 in retrievable form in its files, we will delete that information from our existing files.
Cookies & Computer-Related Information
We may use cookies, web beacons, and other web-based technologies to associate certain Internet-related information about you. A cookie a small amount of data stored on the hard drive of your computer that allows your computer’s browser to store your preferences, and which allows us to identify your IP address with corresponding information in our database. Cookies may be used in website system administration to keep track of movement of an individual Site visitor from one screen to another. Please note that we may still retain and use such information for the sole purpose of critical product or service updates or servicing, or in order to continue providing you with the products and services you continue using, such as to fulfill our product warranties or to provide our App.
Other Internet sites you visit, including those linked from the Site or App, may have their own privacy policies or no policy at all. Other websites might use personal information differently than our Policy permits. We strongly encourage you to review the privacy policies of any site before providing any personal information.
Data Integrity and Security
We use reasonable measures to keep any information you provide as secure as possible. We also have in place privacy protection control contractual obligations with our vendors designed to ensure that personal data is protected from unauthorized access or disclosure. All of Kapsul’s employees and contractors must abide by standard confidentiality obligations. Only authorized employees are permitted to have access too personally- identifiable data about Site visitors, and that access is limited to what is reasonably needed to perform an employee's responsibilities, such as providing updates, notices, or customer service.
