Kapsul W5 Window Air Conditioner Limited Warranty
FIRST THROUGH SECOND YEAR
Warranty for Any Part: If any part supplied by Premium Home Comfort, Inc. d/b/a Kapsul (“Kapsul”) fails because of a proven defect in workmanship or material within 24 months from the date of original purchase, Kapsul will repair or replace the product at no charge.
THIRD THROUGH FIFTH YEAR
Warranty only for Sealed Refrigerant System: If the Sealed Refrigerant System (defined for this warranty as the compressor, condenser coil, evaporator coil, reversing valve, check valve, capillary, filter drier, and all intersecting tubing) supplied by Kapsul in your W5 fails because of a proven defect in workmanship or material within 60 months from the date of purchase, KAPSUL will pay the cost for the authorized labor and parts necessary to repair the Sealed Refrigeration System; provided Kapsul will not pay the cost of diagnosis of the problem, removal, freight charges, transportation of the air conditioner to and from the Service Agency, or the re-installation charges associated with repair of the Sealed Refrigeration System. All such costs will be the sole responsibility of the owner. Other than the Sealed Refrigerant System as detailed above, no other parts or systems is eligible for any warranty beyond 24 months from the date of the original purchase.
APPLICABILITY AND LIMITATIONS
This warranty is applicable only to units retained within the Fifty States of the U.S.A., District of Columbia, Puerto Rico, and Canada. This warranty is not applicable to:
1. Air filters, fuses, batteries, other consumables, or cosmetic parts.
2. Products on which the model and serial numbers have been removed.
3. Products which have defects or damage resulting from improper installation, removal, delivery, wiring, electrical current characteristics, maintenance, or storage; or caused by an accident, misuse or abuse, fire, flood, alterations, misapplication of the product, services performed by unauthorized service companies, or the use of non-genuine parts from providers other than Kapsul; or units installed in a corrosive atmosphere; or default or delay in performance caused by an act or event beyond Kapsul’s reasonable control, including without limitation acts of God, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, terrorist attack, war, fire, explosion, storm, flood, earthquake, epidemic or other natural disaster, stay at home orders, failure of public or private telecommunications networks, or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
4. Smart appliance connectivity issues outside of Kapsul’s reasonable control, such as issues relating to the owner’s smartphone or other device, internet availability, software compatibility, wireless network connectivity, or network interference.
OBTAINING WARRANTY PERFORMANCE
Any eligible service will be provided by the Kapsul Authorized Dealer or Service Organization in your area. Authorized individuals or companies are listed on the Kapsul website. LIMITATIONS AND WARRANTY DISCLAIMERS
THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, AND THE REPAIR OR REPLACEMENT OF ELIGIBLE PARTS AS STATED HEREIN CONSTITUTES OWNERS’ SOLE AND EXCLUSIVE REMEDY. NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, ANY IMPLIED WARRANTIES INCLUDING THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, QUALITY, OR MERCHANTABILITY SHALL BE LIMITED TO ONE YEAR OR THE SHORTEST PERIOD ALLOWED BY LAW. KAPSUL HEREBY EXPRESSLY DISCLAIMS AND EXCLUDES ANY AND ALL LIABILITY FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGE RESULTING FROM ANY BREACH OF ANY EXPRESS OR IMPLIED WARRANTY.
Some states do not allow for the exclusion or limitation of incidental or consequential damages, or limitations on the duration of implied warranties. This limited warranty provides you with specific legal rights, but you may also have other rights that vary from state to state.
PERFORMANCE OF WARRANTY
Performance of Kapsul’s warranty obligation is limited to one of the following methods:
- repair or replacement of the defective part or unit;
- a refund to the customer for the prorated value of the unit based upon the remaining warranty period of the unit; or
- Providing a replacement unit of equal or greater value.
The method of fulfillment of the warranty obligation is at the sole discretion of Kapsul.
PROOF OF PURCHASE
Owner must provide original proof of purchase (such as a Kapsul sales receipt or delivery slip) in order to establish the date of purchase and receive any warranty related services. All service calls for explaining the operation of the product will be the sole responsibility of the owner. All eligible warranty service must be provided by an Authorized Kapsul Service Agency, unless otherwise authorized by Kapsul prior to services being made.
Kapsul W5 Window Air Conditioner Return Policy
Premium Home Comfort, Inc. d/b/a Kapsul (“Kapsul”) offers legitimate purchases of its W5 window air conditioner product with a 30-day return policy.
ELIGIBILITY
To be eligible for a return, the product owner must have purchased the W5 product directly from Kapsul’s website at the kapsulair.myshopify.com domain, the product must be unused and in the same condition that it was received and in its original packaging, and the product owner must notify Kapsul and return the product no later than 30 days following the date of delivery (the "Refund Period"). The product is not eligible for a refund after the 30-day Refund Period. Product owners who received the W5 air conditioner through a testing program, promotion, giveaway, or as a crowdfunding backer are not eligible for any refund or exchange.
INITIATING RETURNS
To initiate a return, the product owner must inform Kapsul within the Refund Period by contacting Kapsul customer support and emailing support@kapsulair.com, and clearly stating the owner’s desire to return the product. To be eligible for a refund, the owner must provide a receipt or proof of purchase for the returned product. Kapsul also requests that the product owner include details on where and when the product was purchased and the reason for returning the product.
The product owner will be solely responsible for all costs associated with returning the product to Kapsul (including uninstallation and the cost of shipping the product back to Kapsul). Kapsul recommends that all return shipments be made using a trackable shipping service, and covered by adequate shipping insurance. Kapsul does not guarantee that it will receive any returned product.
To return the product, the owner should mail the product to Kapsul, 2212 Walnut Street, 1st Floor, Philadelphia, PA 19103.
REFUNDS
Once a return is received and inspected, Kapsul will notify the owner and provide confirmation of the approval or rejection of the refund request. If the refund was approved, Kapsul will refund the price the owner paid for the product, exclusive of the original delivery cost, less the value of any promotional merchandise or discounts the owner received. Shipping costs are non-refundable.
If the product was purchased as part of a bundle of multiple products sold together at a discount, Kapsul will not provide a refund if the return is only for part of the bundle, and all of the products sold together in that bundle must be returned together in order to receive any refund. Kapsul may reduce the amount of any approved refund to reflect any reduction in the value of the product, as determined in Kapsul’s sole discretion, caused by the owner handling them in a way which goes beyond what is necessary to establish their nature, characteristics and functioning (e.g., beyond what would normally be permitted in a shop).
Kapsul will process the refund due to you as soon as possible and, in any case, within 45 days from the date of receipt by Kapsul of the approved returned product.
GIFTS
If the product was marked as a gift when purchased and shipped directly to the product owner, the owner (if eligible for a refund) will receive a gift receipt for the value of the return. Once the returned product is received and approved by Kapsul, a gift certificate or Kapsul account credit will be provided to the product owner.
EXCHANGES
Kapsul may, at its sole discretion, agree to provide a replacement product in lieu of a refund. The product owner request an exchange will be responsible or the cost of shipping the exchanged product. Depending on the product owner’s shipping address, the time it may take for the exchanged product to arrive may vary.
